The National Biodiversity Authority (NBA) has clarified that submission of Form-10 under the Biological Diversity Rules, 2024 is applicable to:
Any person or entity intending to use in India:
• Foreign biological resources, or
• Associated traditional knowledge obtained from a foreign country
where such use is for:
• Research
• Commercial utilisation, or
• Filing or obtaining Intellectual Property Rights in India
The requirement applies only where access or intent to use such resources arises on or after 21 December 2024.
The declaration mechanism under Rule 18 is intended to enable the NBA to monitor and regulate the use of foreign biological resources within lndia and to ensure compliance with the provisions of the Biological Diversity (Amendment) Act, 2023.
